Intellectual Property

Berliner Corcoran & Rowe's IP practice complements its transactional and dispute resolution practice. The firm advises on trade secret law, trademark law and copyright law but not patents.

Trade secret protection relates to our client's undisclosed knowhow in the satellite industries as much as it involves processes that a client needs to keep secret. We help avoid the disclosure that would be required for a patent and yet keep a secret protected in commercial interaction for decades.

Trademark protection at the firm involves the registration of trademark in many industries and the resolution of disputes over Lanham Act claims within the trademark registration process and in commercial domestic and international litigation and arbitration. We assist our clients in the negotiation of co-existence agreements, often in the context of U.S. registrations following international registrations under the WIPO and Harmonized systems.

Copyright work at Berliner, Corcoran & Rowe LLP is a mainstay in our computer and internet law practice.

Domain name law and conflict resolution are included in this practice area as well.

The firm has actively represented licensors and licensees in their development, financing, distribution, outsourcing or merchandising activities. We represent companies in the games, game financing, mainframe database, general support and service, architectural programs and many more fields. Some require in-depth understanding of technical issues, others reqire experience in dealing with financiers, for instance in mergers and acquisitions.

Most of the IP work we perform for our clients crosses over to related fields, such as commercial transactions, export controls, government procurement, employment law and even succession and probate.

Clients in this practice area range from the globally largest to true garage-style start-ups.

BCR's attorneys are intimately familiar with the computer industry and its needs, including content development, licensing, distribution, source code protection and more.,/p>

Primarily involved in these areas are Clemens Kochinke (market, business, development, strategy, alliances), Wayne Rusch (corporate and financing), Ben Flowe (export controls), Bruce Zagaris (internet gambling and international crime), and John Ordway (government procurement).
